Parking Regulations
Article I
Parking and operation of Motor Vehicles on State System of Higher Education
Facilities are regulated by Title 22 (Education), Part XVII. State System of
Higher Education, Section 507.13 Crimes and Offenses related to the operation
and parking of a motor vehicle, and Section 507.14 Enforcement.
Definitions
Section 200. Clarion University. All lands and buildings owned or leased by the university and operated by Clarion University, including Clarion University's Venango campus.
Section 201. Vehicle. Every device in, upon, or by which any person or property is or may be transported or drawn upon a highway.
Section 202. Loading Zone. Those spaces or areas that are officially marked by signs and for explicit use of actively loading or unloading of materials. Time limitations and other restrictions in loading zones may be enforced if signs so indicate.
Section 203. Visitors and guests. Those persons not currently employed at Clarion University or not currently enrolled at the university as a student.
Section 204. Unauthorized area. Any area where a vehicle has not been assigned to park. All vehicles which do not display a valid parking permit issued by the Department of Public Safety and are parked on university property shall be assumed to be parked in an unauthorized area, which shall be deemed prohibited parking (refer to Section 400).
Section 205. University. Clarion University of Pennsylvania of the State System of Higher Education.
Section 206. Parking space. A parking space is defined as any area that shall be marked by lines or signs.
Section 207. Zone of Ineligibility. Off campus housing (at the Clarion campus only) considered to be within walking distance to the campus, as defined by the university. Students whose local or permanent address is within this area are not eligible for a university parking permit.
Section 208. Commuter Student. Any university student whose local residence is outside the Zone of Ineligibility.
Section 209. Residence Hall Student. Students residing in university owned residence halls.
Section 210. All other definitions in the rules governing Parking Regulations at Clarion University shall be the same as those definitions in Title 75 of the "Vehicle Code for Pennsylvania," Section 102.
Parking Permit Registration
Section 300. Driver Responsibility
A. Permit Required. Every employee, student, guest, and contracted employee of, or at, Clarion University, who parks a vehicle on University Property in a lot requiring a permit, must obtain a permit with the Department of Public Safety. At branch campuses, parking permits may be obtained at the administrative offices.
B. Permit Designations. Student permits shall be valid only in assigned student lots, and employee permits shall be valid in all employee lots unless designated differently on the permit (i.e., HP). All other lots shall be considered to be unauthorized areas. Only one parking permit (of any type) will be issued to an individual. A person's classification (employee or student) shall be determined by the primary purpose for his/her being on campus.
C. Hours of Enforcement. The enforcement of parking permit regulations for employee lots, commuter lots and metered parking shall be from 8:00 AM until 4:30 PM, prevailing time, Monday through Friday, unless otherwise designated. There shall be no parking in any commuter lot or employee lot between the hours of 2AM and 6AM, seven days a week. The enforcement of permit regulations for Resident Lots shall be 24 hours a day, 7:30 AM Mondays through 4:30 PM Fridays. Handicapped parking regulations are enforced 24 hours per day, seven days a week.
Section 301. Parking Permits
General Rule. A valid university parking permit must be hung down from the inside rear-view mirror and be clearly visible from the front of the vehicle when the vehicle is parked in a university-controlled area. An individual who forgets his or her parking permit must obtain a one-day temporary permit from the Department of Public Safety or the administrative offices at the Venango campus. Temporary permits must also be displayed as stated above. Short-term parking is available at the Public Safety office on Thorn Street to obtain a temporary permit.
Motorcycles and mopeds must display the special affixed parking permit adjacent to the inspection sticker.
Permits must be secured and displayed for the following:
1. Students. A limited number of permits will be sold to students. Applications can be found on the parking website, www.clarion.edu/parking. Any person who cannot access the website may contact the Public Safety Office by phone for an application. If the number of applications received exceeds the number of permits, a lottery will be used to award permits. If permits are still available after the August 1st deadline, they will be awarded on a first come, first served basis. Permit applications can be submitted online, mailed or dropped off in person at the Public Safety Office. Phone applications are not accepted.
a. Grace Period. Students are given a grace period in which to obtain a permit.
During the Summer Semester, student vehicles will not be ticketed in student lots for
During the Fall and Spring Semesters, student vehicles will not be ticketed in student lots for 'failure to properly display a permit' during the first 5 days of the term. There is no grace period in non-student lots.
"failure to properly display a permit" during the first 3 days of the term. There is no grace period in non-student lots.b. Payment of Outstanding Tickets. All past parking tickets must be paid prior to the issuance of a permit.
c. Proof of Local Address. The University reserves the right to require a student to provide proof of their local residence prior to being issued a permit. Any student who provides false information regarding his or her local address will have their parking permit revoked and will be subject to disciplinary action. Students whose local or home address falls within the Zone of Ineligibility shall not be eligible for a university parking permit.
d. Billing. Students' accounts will be billed for the amount of the permit at the time the application is processed. Students who apply for a permit online prior to August 10 will receive their permit by mail at their home address of record by way of USPS Priority Mail. Permits should arrive in early August. Postage fees will be added to the cost of the permit when the student is billed.
e. Types of Student Permits. The following types of permits are available to students. Lot signs bear a colored circle or dot according to permit type.1. Commuter Permit. Students who reside off campus AND outside the zone of ineligibility are eligible for a commuter permit at a cost of $100 per year. After January 1, the permit cost shall be $50. Students possessing a commuter permit must park in lots designated as commuter lots by a red circle on the sign(s) in that lot(s).
2. Resident Permit. Non-freshmen students residing in University-owned residence halls are eligible for a Resident permit at a cost of $100 per year. After January 1, the permit cost shall be $50. Students issued a Resident permit must park in lots designated by a light blue circle on the sign(s) in that lot (s).
3. Resident Freshmen Permit. Freshmen residence hall students are eligible for a permit at a cost of $100 per year. After January 1, the permit cost shall be $50. Resident Freshmen students must park in Lots designated as Resident Freshmen lots by a yellow circle on the sign(s) in that lot(s).
4. Student-Stadium Permit. Any residence hall student OR any commuter student whose local residence is outside the zone of ineligibility is eligible for a Student Stadium permit free of charge. Student-Stadium permits are valid only in the Stadium Parking Lot designated by a light green circle on the sign(s) in that lot. All vehicles must be removed from the stadium lot by 6:00 PM on the Fridays before home football games.
5. Venango Commuter. Students deemed Venango students by the university Registrar shall be eligible for a Venango Commuter Student Permit at a cost of $15 per year. After January 1, 2005 the permit cost shall be $8. Students issued a Venango Commuter Student permit may park in any student lot at the Venango campus or in lots designated for Commuter students at the Clarion campus.f. Any student who parks a vehicle on campus in a lot requiring a permit must display a valid university permit while parked. Any student who has been issued a parking permit and who withdraws from the university prior to April 30 must return the their permit to the Public Safety Office within 24 hours of their last class. Residence hall students who possess a permit and who vacate their room prior to April 30 must return that permit to the Public Safety Office within 24 hours. Students who return their permit prior to January 21 will receive credit for one half of the cost of the permit on their student account.
2. Employees. New employees must register immediately with the Department of Public Safety. All others must register prior to the expiration of their current permit. Employees may park only in employee lots designated with a black circle on the sign(s) at that lot(s).
3. Handicapped Parking. The University requires all vehicles parked in a designated handicapped parking space to display a state-issued handicapped parking placard. In order to further accommodate the physically impaired, the University issues a “physical impairment” permit that is valid in any legal space EXCEPT handicapped spaces and metered spaces.
Physical Impairment Parking Permits are available to those who meet the University’s guidelines. A University Physical Impairment parking permit allows a person to park in any legal space except for metered and handicapped spaces. A Physical Impairment Permit is valid in any student or employee lot. In other words, with a university physical impairment permit, a student can park in an employee lot and visa versa.
There are two ways to receive a Physical Impairment Parking Permit:
1. Present a valid state-issued handicapped placard to Public Safety
2. Complete the Application for Physical Impairment Permit.
NOTE: Applicants must complete the Application for Physical Impairment Parking Permit application and forward it to his or her physical for the physician’s certification statement. This form has been adapted from the Commonwealth of Pennsylvania, Department of Transportation, Bureau of Motor Vehicles form MV-145A.
4. Student Temporary Permits. Students may obtain a temporary parking permit up to three times per semester as long as they meet the eligibility requirements for a university permit. Each temporary permit will be issued for a maximum of one week at a cost of $10 per week. If a parking permit is needed more frequently, the student must purchase a regular permit.
5. Visitor or Guest Parking. Upon arrival on campus, visitors and guests must either park in a metered space or procure a parking permit from the Department of Public Safety or the administrative offices at branch campus.
6. Expiration. All permits expire August 30 of each year.
Section 302. Misuse of Permits. Permits are non-transferable. Permit holders may not give, loan, or sell their permit to any other person.
Section 303. Misstatement of Facts to Obtain Parking Permit. Any person who falsifies information when applying for a parking permit shall have their parking privileges suspended for the remainder of the academic year in addition to any other penalties listed below. Furthermore no person shall display a permit which was obtained based on false information. Students may also be subject to campus disciplinary proceedings.
Section 304. Altering of Parking Permits. No person shall alter or change a
parking permit in any way.
Prohibited Parking
Section 400. No person shall park a vehicle or permit it to stand attended or unattended at Clarion University in any of the following places:
A. within an intersection;
B. on a crosswalk;
C. on a sidewalk;
D. in a loading zone or 'official use only' area
E. on a roadway within 15 feet of a fire hydrant;
F. in an unauthorized area;
G. in any permit parking area other than in the assigned lot(s) designated according to type of permit. (See Section 301);
H. in a handicapped area, unless the operator/passenger is handicapped and a university issued handicapped permit is displayed;
I. in any area other than a regularly designated parking space which shall be marked by lines or signs.
J. at an expired metered space, between the hours of 8:00 a.m. and 4:30 p.m. Monday through Friday. An electronic pay station may be used to replace multiple meters in larger lots.
K. in any commuter student lot or employee lot between the hours of 2AM and 6AM. This time restriction shall apply to all vehicles, regardless of permit designation.
L. In a lot that has been posted as a closed lot.
Section 401. Parking Position.
A. Vehicles must be parked in such a manner that the permit and license plate are clearly visible.
B. Vehicles shall not park across lines denoting parking spaces.
C. Vehicles parked parallel to the curb must ensure that both tires closest to
the curb are no more than 12 inches from the curb.
Section 402. Visitor or Guest Parking. Employees and students are not permitted to park in designated guest or visitor areas.
Section 403. Towing of Vehicles.
A. The director of public safety or designee at Clarion University may order any parked vehicle to be removed from the campus and impounded for any of the following reasons:
1. when the position of such vehicle presents a safety hazard to the public or to property;
2. when the vehicle is illegally parked in any handicapped parking space;
3. when any individual is found to be in flagrant violation of the parking regulations including, but not limited to, parking a vehicle without a permit following suspension of parking privileges;
4. when the vehicle is parked in any parking area or space marked as a tow away zone;
5. when the vehicle has been immobilized (booted) more than 24 hours
6. when evidence exists that an immobilizer has been tampered with or an attempt has been made to forcibly remove an immobilizer.
7. when the Public Safety officer issuing the ticket is unable to determine ownership of the vehicle in violation.
B. The rate for towing shall be no more than the prevailing area rate.
C. Within 12 hours from the time of removal of such vehicle, notice of the fact that such vehicle has been impounded shall be sent by the Clarion University Department of Public Safety to the owner of record of such vehicle, designating the place from which said vehicle was removed, the reason for its removal and impounding, and the location at which it has been impounded.
D. The payment of towing charges shall be final and conclusive and shall constitute a waiver of any right to recover the money so paid.
E. No vehicle shall be removed under the authority of an impounding ordinance if, at the time of such intended removal, the owner or custodian of such vehicle is present and expresses a willingness and intention to immediately and lawfully remove said vehicle. The owner or custodian is responsible for all fees of the towing company if the tow truck has been dispatched.
Section 404. Immobilization of Vehicles. A vehicle immobilizer of a type approved by the university may be installed by any public safety officer of Clarion University with the approval of the director of public safety or designee in the following instances:
A. Installation. The vehicle immobilizer will be installed:
1. when the vehicle has three or more outstanding parking tickets.
2. when determined appropriate by the director of public safety or designee.B. Notification. When the vehicle immobilizer is installed upon a vehicle, the following procedure shall be followed:
1. A tag shall be attached in a conspicuous place on the vehicle indicating the immobilizer has been placed on the vehicle.
2. A notice of violation shall be attached to the vehicle or given to the operator indicating the violation which has occurred.C. Removal. The immobilizer may be removed:
1. upon payment of all pending violation notice(s) and a service charge of $30.00; and/or
2. upon direction of the director of public safety, or designee.
Section 405. Temporary Closing of Sections of Campus. The director of public safety or his or her designee shall have the authority to temporarily close or restrict parking and/or traffic on Clarion University campuses.
Section 406. Exclusion. Emergency and service vehicles directly engaged in the performance of assigned duties are excluded from this article; however, said vehicles shall not be parked or operated in any manner which will constitute a safety hazard. Persons parking service vehicles in such a manner as to create a traffic or safety hazard shall pay a fine of $10.00.
Section 407. PENALTY-Except as provided for in Section 408, any person violating any provision of Article III or Article IV shall pay a fine of $10.00. Any person violating Article IV, Section 400 h. (Relating to parking in a handicapped space), shall pay a fine of $30.00 for a first offense and shall receive a be issued a traffic citation pursuant to Section 3354 of PA Title 75 (Vehicle Code)for each subsequent offense. In addition, vehicles illegally parked in a handicapped space may be towed at the owner's expense.
Section 408. Habitual Offenders. Any person who receives five or more valid parking tickets in an academic year, paid or unpaid, shall be considered an Habitual Offender. All subsequent fines shall increase to $30 per ticket for the remainder of the academic year.
Traffic Signal or Sign Interpretation
Section 500. Signs or Signals. No person shall disobey the directions of any traffic signal, sign, or device unless so directed by a public safety officer.
Section 501. Parking Lot Signs. Parking lot signs are color coded:
Employee lots-Black Dot
Commuter lots-Red Dot
Residence Hall Student Lots-Light Blue Dot
Resident Freshmen Lots-Yellow Dot
Student Stadium Lot-Light Green Dot
Penalty. Failure to obey traffic signals, controls, signs, or devices will result in a citation being issued under the applicable Vehicle Code (Title 75) provision.
Appeals
Section 600. Procedure. Parking violations may be appealed, with payment, to
the director of public safety in writing within 72 hours after the violation.
The subcommittee of the parking committee will act on the appeal within 45 days.
The decision of the subcommittee may be appealed to the full University Parking
Committee. Appeals to the University Parking Committee must be made in person at
regularly scheduled meetings of the parking committee. Notice of action taken by
the committee will be sent to each person appealing the decision of the
subcommittee. Appeals received without payment will not be considered for the
appeal process and will be subject to additional legal actions.
Enforcement Provisions
Section 700. Limitation of Actions.
A. Notice. Any person charged with violating any of the provisions of these rules shall be served with a notice of said violation. The notice shall show the nature of the offense charged and the time, date, and place of the alleged offense. Said notice shall bear identification of the public safety officer or designee issuing same.
B. Frequency of violation notices. A vehicle which is illegally parked at the university shall be subject to receiving a notice of violation for each six hours which the vehicle is illegally parked. Each notice of violation shall constitute a separate offense.
C. Any person receiving from a public safety officer a notice as provided in this act for improper parking must pay the prescribed penalty (in U.S. Currency) to the Department of Public Safety or administrative office at branch campuses within 72 working hours after the violation. Payment will terminate any further prosecution of the offense.
D. All violations not paid within 72 working hours of the issuance of a violation notice will have the fine increased by $1.00. The Office of Public Safety reserves the right to file a citation before a magistrate for all violations not paid within 14 days.
E. Paying with Minor Coins. (U.S. Federal Code, Book 31, Section 460.) "One does not have to accept, count, wrap, or process any minor coins in excess of 25 cents, minor coins being nickels or pennies."
F. A citation charging violations of any of the provisions of these rules shall be brought before a magistrate within the county where the alleged violation occurred and shall include such detail as the department may prescribe as being necessary for its records.
Registration Plate/Parking Permit Number Prima Facie Evidence. In any proceeding for a violation of the provisions of these regulations, the registration plate or parking permit displayed on such vehicle shall be prima facie evidence that the owner or custodian of such vehicle was operating same. If at any hearing or proceeding the owner shall testify under oath or affirmation that he or she was not in control of the vehicle at the time of the alleged violation and shall identify the individual in control at the time of the offense, then the prima facie evidence arising from the registration plate or parking permit shall be overcome and removed and the burden of proof shifted. If the information is filed in a county other than that of his or her own residence, he or she shall forward to the magistrate a notarized affidavit setting forth these facts. However, he or she will be subject to the provisions of Section 302.
Section 701. Legal Procedure. Proceeding by citation, complaint, or warrant before a magistrate shall be in accordance with the rules of Criminal Procedure in effect at the time of the violation.
Section 702. Cost of Prosecution. When violations are prosecuted through the court system under Parking Regulations for vehicles at the campuses of Clarion University of Pennsylvania, all penalties, cost of prosecution, and bail forfeited shall be paid to the Court.
Revisions
Section 800. Revisions of Rules. The Director of Public Safety, in consultation with the Parking Committee, may recommend to the university vice president for finance and administration such revisions to the Parking Regulations for vehicles at the campuses of Clarion University of Pennsylvania as is deemed necessary for approval by the President.
Separability
Section 900. Separability. If any provision herein is determined to be invalid and unenforceable by a court or other authority having jurisdiction, such provision will be considered void, but all other valid provisions hereof will remain in full force and effect.
Responsibility of the University
Section 1000. The university assumes no responsibility nor is it liable for any damage done to vehicles or their contents or articles taken from vehicles when parked on any university campus.
Effective Date
Section 1100. Effective Date. These rules shall take effect immediately.
